GENERAL PROPERTY QUESTIONS

HOW DO I GET A NEW ADDRESS?
  • Contact the Planning & Zoning (PZ) office for determination of property status and whether your proposed use of the property meets the zoning district regulation. Please have either the parcel number or current owner's full name when you call. The PZ office will complete a Zoning Compliance Review and email it to the E-911 Addressing office.   • Contact E-911 Addressing office for status after PZ review. You may reach them at  931-433-8404.
The average turn-around time is dependent on staff availability and workload, but can typically be completed within a couple days.

HOW DO I FIND THE ZONING OF A PROPERTY?
Currently the Zoning Map is not available on line. You may call the Planning & Zoning office and they will gladly assist you. Please have either the address,  parcel number or owner's full name ready.  You may reach Planning & Zoning at 931-438-5186 or email planning@lc-tn.com

HOW CAN I CHANGE THE ZONING CLASSIFICATION OF MY PROPERTY?
Rezoning property requires approval from the Planning Commission, a Public Hearing and County Commission majority vote.
  • Rezoning requests are submitted to the Planning & Zoning (PZ) office for distribution and scheduling for Planning Commission (PC) review. Request shall be in writing, on a form provided by the PZ office. This form can also be found on the County website under FORMS & APPLICATIONS, select AMENDMENT APPLICATION. Request shall be accompanied with a current survey of the property and application fee of $120.00. If required mailing exceeds $30.00, applicant shall be responsible for the overage amount.
  • Upon approval, the PC will forward their recommendation to the County Commission (CC) for consideration. Before approving any amendment/rezoning, the County Commission shall call a public hearing for their next month's meeting, or, they may opt to schedule a special, “Called Meeting” for a certain date. Note, the CC may opt to deny or defer the request back to the PC.
 
  • After the public has an opportunity to be heard and the hearing is closed, the CC will vote on the rezoning request.

HOW CAN I FIND THE ASSESSED VALUE OF A PROPERTY?
There are two ways to obtain this information. You may contact the Property Assessor's office at 931-433-5409 or go to http://tnmap.tn.gov/assessment/. This is an interesting site that provides a wealth of information. Check out the different tool options.

HOW DO I KNOW IF I'M IN A FLOOD ZONE?
By using the TN Property Viewer site above, click on the tab along the upper left side titled "Show FEMA DFIRM Flood Map" or by going to msc.fema.gov. It should be noted that if your property contains any special hazard flood designation, any development (including driveways, new structures, utilities, etc.) is required to be approved, as per FEMA regulations, regardless if the proposed development encroach into the special hazard zone or not. Approval is issued through the EMA office. It is recommended that you always verify the information by calling the EMA office at 931-438-1575.

I WANT TO SUBDIVIDE MY LAND, WHAT DO I NEED TO DO?
Whenever land is divided (termed “ subdivided”), it must be approved by the Planning Commission (PC) and the Fayetteville-Lincoln Co. Utility Committee.

Minor subdivisions are eligible to be fast-tracked. These are divisions of land, with less than five (5) lots, not requiring new public roads or extension of public facilities. The surveyor may send an electronic plat for review, typically taking 5-7 days for turnaround. When approved, four (4) hard copies are submitted to the PZ office for signature. Applicant may then record the plats with the Register’s Office.

EXCEPTIONS - If both the remaining parent parcel and proposed subdivided land are each five (5) acres or greater and do not require a new public roads or extension of public facilities, the subdivision is exempt from gaining any type of approval. It must still be recorded with the Register’s Office and mapped.

Major subdivisions must be presented to the Utility Committee and Planning Commission for approval. These are divisions of land of five (5) or more lots.

ALL subdivisions, whether exempt from gaining approval from the Utility Committee or the Planning Commission, must be fully executed and recorded with the Register of Deeds office. PERMIT QUESTIONS

DO I NEED A BUILDING PERMIT?
Note: Currently all building inspections are conducted by the State. The following information is derived from state requirements. You are encouraged to call the Planning & Zoning office to determine the zoning district and setback regulations prior to building.

Permits are issued by the Planning & Zoning office, utilizing an online state website. Fees are collected at the time of issuance.

Residential Construction - Permit required for: New Single-family dwelling; Two-family dwellings; Townhouse; Additions; and Site Construction for Manufactured|Modular Homes. Inspections are conducted by a state inspector on Tues and Thurs.
(EXEMPT: Detached, non-habitable structures, i.e. detached garage, carports, accessory buildings)

Commercial Construction - Less than 5,000 sq. ft. and less than 3 stories Currently does not require a permit but does require Planning Commission review and approval . Please refer to the Zoning Regulations, Article II - Section 2.080, found on the county website for the requirements. Electric – Issued through Fayetteville Public Utilities - Engineering Office. Permits are issued through FPU with inspections conducted by a state electrical inspector. For assistance, you may reach FPU at 931-433-1522, ask for Engineering.

Septic Tanks - New construction, failing systems or additional bedrooms. Check with the local TDEC Division of Water Resources office, located at the Health Dept. at 1000 Washington St., West. Permits and inspections are through the TDEC office. For assistance, you may reach them at

WHAT IS REQUIRED TO OBTAIN A BUILDING PERMIT?
Residential
  • Zoning Compliance Review – Issued by Planning & Zoning   106 College St, West, Fayetteville, TN 37334 (931) 438-5186
    • Site Plan showing proposed distances (setbacks) to property lines and all easements. Approximate distance for acreage parcels is acceptable. Template available through Planning & Zoning office.
    • A copy of deed, if acting as an Owner-Builder. Available at the Register’s office, Lincoln Co. Courthouse, 112 Main Ave., S. Room 104 (931) 433-5366
    • If property contains a Special Hazard Flood Zone (Zone A or AE), a Flood Development Permit approval is required through Doug Campbell, Floodplain Manager, Lincoln Co. Emergency Management Agency. 312 Market St., West, Fayetteville, TN 37334 (931) 438-1575.
    • Approved septic tank permit (copy is acceptable) from TDEC 1000 Washington St., West Fayetteville, TN 37334 931-438-1998
    • Driveway connection approval. 
      • County Road. Driveway culvert sized and approved by Lincoln Co. Hwy Dept., 161 Molino Rd. Fayetteville, TN 37334 (931) 433-2585
      • State Road. Connection approval and culvert sized by TDOT, (931) 438-1914
    • Approved address issued through E911 Addressing Office. If driveway is not in place then it must be staked and flagged on both sides of proposed drive. Note; New driveway shall be 25 ft. from any adjacent driveway. E911 Addressing (931) 433-8404.
    • Contractors must show valid TN State Contractor's License and Certificate of Insurance reflecting both liability and worker's comp (or exemption).

Commercial - Construction greater than 5,000 sq. ft. and more than 3 stories will be reviewed by the State Fire Marshal’s office.

LICENSING QUESTIONS

DO I NEED A LICENSE FOR A HOME BUSINESS?
In short, yes. However, only certain types of businesses are allowed to operate from your home. Check with the Planning & Zoning office if your business is permitted. If you are a tenant, written authorization from the property owner is required. Some properties have covenants and restrictions (what you can and cannot do on the property) that were placed by either the developer or previous owner. Check the deed to verify.

All licenses require a Business License (state license) from the County Clerk’s Office, located at the Courthouse. Stop by the County Clerk’s office FIRST to get your application for a Business License, THEN come to the Planning & Zoning office to complete the Home Occupation (local license) application. The application for a Business License must be approved by the Planning & Zoning office before the County Clerk may issue a Business License.

COMMERCIAL BUSINESS LICENSE REQUIREMENTS
Before you lease or purchase a commercial location to run your business, verify the zoning district with the Planning & Zoning Office to determine whether the type of business is permitted within the district.

All licenses require a Business License from the County Clerk’s Office, located at the Courthouse. Stop by the County Clerk’s office FIRST to get your application for a Business License, THEN come to the Planning & Zoning office. The application for a Business License must be approved by the Planning & Zoning office before the County Clerk may issue a Business License.
